Three men are facing felony drug charges following their arrest on Tuesday Officers with The Mitchell Police Division executed a search warrant at a residence located at 601 E. 5th Avenue in Mitchell. Over 3 grams of methamphetamine, less than 2 ounces of marijuana and several items of drug paraphernalia were seized as a result of this investigation. The following people were arrested regarding this investigation:
– 53 year old David Louis Stock, d. o. b. 04-11-1964, and 44-year-old Jeremy Dean Johnson d. o. b. 10-07-1972 who resided at 601 E. 5th Avenue, Mitchell, S.D. were arrested for the offenses of Unauthorized Possession of a Controlled Substance Schedule 1 or 2, in violation of S.D.C.L. 22-42-5, and for Possession of Drug Paraphernalia in violation S.D.C.L. 22-42A-3. In addition, Stock was arrested for Possession of Less than 2 ounces of marijuana in violation of 22-42-6.
– 33 year old Mitchell resident, Adam Paul Kowall d. o. b. 12-01-1983 was arrested for the offenses of Unauthorized Possession of a Controlled Substance Schedule 1 or 2, Possession of Drug Paraphernalia in a motor Vehicle, Having an Open Alcoholic Beverage Container in a Motor Vehicle in violation of S.D.C.L. 35-1-9.1, Driving with a Suspended Driver’s License in violation of S.D.C.L. 32-12-65 (2) and for Possession of a Suspended Driver’s License in violation of S.D.C.L. 32-12-67.
Unauthorized Possession of a Controlled Substance, Schedule 1 or 2, is a class 5 Felony, punishable by 5 years imprisonment in the state penitentiary and a fine of $10,000. Possession of Drug Paraphernalia, Driving with a Suspended Driver’s License and Having an Open Alcoholic Beverage Container in a Motor Vehicle are Class 2 Misdemeanors, punishable by 30 days imprisonment in a county jail and/ or a $500 fine on each count. Possession of Less Than 2 ounces of marijuana and Possession of a Suspended Driver’s License are Class 1 misdemeanors punishable by up to one-year imprisonment in a county jail and/or a $2,000 fine on each count.
